These Terms and Conditions apply to all purchases made via the Cromwell Antiques website. By placing an order, you agree to be bound by these terms.
1. About Us
1.1 Business Identity: Cromwell Antiques is a trading name of Stone Mountain Trading.
2. Description of Goods
2.1 Antiques & Condition: You are purchasing antiques. By their nature, these goods will show signs of age, wear, and previous use. 2.2 Descriptions: Any statement regarding age, provenance, or origin is a matter of professional opinion and not a definitive guarantee. We provide detailed photographs; please review them carefully as they form part of the description.
3. Orders and Pricing
3.1 Formation of Contract: A legally binding contract is formed only when we send you a dispatch confirmation email. We reserve the right to cancel an order and provide a full refund if an item is unavailable or incorrectly priced. 3.2 Pricing: All prices are in GBP (£). In accordance with the Digital Markets, Competition and Consumers Act 2024, the price shown on the product page includes all mandatory taxes.
4. Delivery and Risk
4.1 Courier & Method: We primarily use Royal Mail for all domestic deliveries. For exceptionally large or heavy items, we may use a specialist courier. All items are sent via a tracked and/or "signed for" service to ensure safe arrival.
4.2 Calculation of Costs: Delivery charges are mandatory (unless an item is collected in person) and are calculated based on the size, weight, and fragility of each individual item. View our Delivery Policy
Upfront Disclosure: The final total is confirmed at checkout. Please view out Delivery and Collection policy for more information.
Bespoke Quotes: For very large or heavy furniture where a standard rate cannot be automated, the product page will state "Delivery quote required." In these cases, the contract is only formed once a delivery quote is agreed upon and the order is confirmed by us. Before purchasing items please contact customer services for a delivery quote.
4.3 Passing of Risk: We remain responsible for the item until it has been collected in person or physically delivered to your specified address or left with a neighbour/safe place authorised by you. Once delivered, the risk of damage or loss passes to you.
5. Your Right to Cancel (The "Cooling-Off" Period)
5.1 14-Day Right: Under the Consumer Contracts Regulations, you have the right to cancel your order for any reason within 14 days of receiving the item. 5.2 Notification: To cancel, you must inform us of your decision by a clear statement (e.g., an email). You may use the contact form provided on the Contact Us page, but it is not mandatory. 5.3 Returns: You must return the item to us in its original condition within 14 days of your cancellation notice. 5.4 Return Costs: You are responsible for the cost of return postage. We strongly recommend using a tracked and insured service (e.g., Royal Mail Special Delivery), as we cannot refund items lost or damaged in return transit. 5.5 Refunds: We will refund the full purchase price (including the cost of standard outward delivery) within 14 days of receiving the item back or receiving evidence of its return.
6. Liability
6.1 Our liability for any loss you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the item. We are not liable for any indirect or business-related losses.
7. Governing Law
These terms are governed by the laws of England and Wales.
